These Terms of Service ("Terms") constitute a legally binding agreement entered into by and between you, whether personally or on behalf of an entity ("User", "you", or "your"), and Nang Locvinh ("we", "us", or "our"), governing your access to and use of our website, algorithmic trading automated systems, indicators, APIs, and related software platforms (collectively, the "Platform").

By accessing, browsing, registering for, or interacting with the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you are expressly prohibited from using our Platform and must discontinue use immediately.

1. Eligibility and Jurisdictional Qualifications

To access or use the Platform, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority required in your home jurisdiction.
• You possess the legal authority and capacity to enter into binding legal agreements.
• You are not a resident of, or physically located in, any jurisdiction where the offering, marketing, or execution of automated digital asset trading violates local laws, statutory prohibitions, or financial regulatory frameworks.
• You have not been placed on any trade embargo, international sanctions, or denied-persons lists maintained by HM Treasury, the United Kingdom, the European Union, the United Nations, or the United States.

2. Platform Services and Technological Scope

Nang Locvinh provides automated algorithmic software tools, machine-learning data processing modules, market intelligence feeds, and automated execution bots designed for interaction with independent cryptocurrency exchanges. You acknowledge and agree that:

• Nang Locvinh is a software technology provider and does not operate as an authorized bank, securities broker-dealer, custodian, or regulated asset manager under the Financial Services and Markets Act 2000 (FSMA) or comparable global statutes.
• We do not hold customer deposits or take custody of your private cryptocurrency keys or fiat funds. All trading actions executed via API integrations occur directly within your self-managed accounts hosted at third-party exchange venues.
• The Platform does not guarantee continuous uptime, uninterrupted connectivity, or zero-latency order placement, as execution depends on independent internet infrastructure and third-party exchange APIs.

3. User Account and Security Obligations

When you establish an account on our Platform, you agree to provide truthful, accurate, and current contact details. You are solely responsible for maintaining the confidentiality of your login credentials, API secrets, and two-factor authentication keys. You accept full responsibility for all activities, trade triggers, and orders that occur under your authenticated user session. You agree to notify Nang Locvinh immediately at [email protected] upon discovering any unauthorized security breach or compromise of your credentials.

4. Permitted and Prohibited Conduct

You agree to utilize the Platform strictly for legitimate personal trading or lawful organizational activities. You expressly agree not to:

• Employ the Platform for money laundering, terrorist financing, illicit market manipulation (such as wash trading, spoofing, or front-running), or violations of international trade restrictions.
• Reverse engineer, decompile, disassemble, or extract source code, neural net model weights, or proprietary algorithms belonging to Nang Locvinh.
• Circumvent, override, or tamper with security protocols, rate-limiting rules, or automated safety stop-loss mechanisms built into the Platform.
• Transmit malicious code, viruses, automated web scrapers, or excessive API loads that disrupt server integrity or client connectivity.

5. Fees, Subscriptions, and Billing

Certain advanced modules, automated bot licenses, and analytics feeds may be subject to recurring subscriptions or licensing fees. All applicable fees will be explicitly detailed prior to purchase. Invoices and payments are denominated in standard currencies or accepted cryptocurrencies. Except as mandated by compulsory consumer protection statutes of England and Wales, all software subscription fees are non-refundable once computational platform resources have been provisioned.

6. Intellectual Property Rights

All intellectual property rights in and to the Platform—including trademarks, proprietary trading bot architectures, user interface elements, graphic designs, software documentation, and analytical algorithms—are the sole property of Nang Locvinh and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and run the Platform tools solely in accordance with these Terms.

7. Disclaimer of Warranties and Limitation of Liability

The Platform is supplied on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied. Nang Locvinh disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and market performance accuracy.

To the fullest extent permitted by applicable law, in no event shall Nang Locvinh, its directors, developers, or affiliates be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, trading capital, data loss, or exchange-side liquidation events resulting from your reliance on automated platform parameters or software delays.

8. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
